  • ONLINE STORE TERMS – READY STOCK IN KENYA
    • Our website offers a range of products and or services for sale. Where we refer to an 'item' we are referring to a single product or service available for purchase on this website.
    • We will take all reasonable care to ensure that the details displayed for a particular item offered for sale are correct at the time when the information was entered onto the system.
    • Whilst care is taken to ensure that we display as accurately as possible appearances, colours, textures or finishes, what you will see on your computer monitor or equipment may differ and so we cannot guarantee that images are an accurate representation of the actual goods or services that you are purchasing.
    • We may not be able to accept your order due to one or more of the following reasons, or for a reason not listed below:
      • The item you have ordered is out of stock
      • We cannot authorise your payment or have reasonable grounds to suspect your payment may be fraudulent
      • There has been a pricing or product description error
      • There is a system or procurement failure
      • You have failed our customer validation checks
    • When you place an order, you will receive an email confirming the details of your order. This email is not confirmation that your order has been accepted by us.
    • Your order will only be accepted by us once your goods have been dispatched.
    • Modifications To Our Service and Pricing
      • Prices for items are subject to change without notice.
      • We reserve the right to, at any time, modify or discontinue any part of the service that we offer, or any part of content thereof, without any notice to you.
      • We accept no liability to you or to any third-party for any modification, price change, suspension, or discontinuation of the service.
    • Delivery
      • During checkout, you may be presented with one or more options for delivery. Where an estimated timescale for delivery is provided, this is an estimate only and your items may be delayed in being received due to circumstances beyond our control (such as a courier delay, or at busy times).
      • Where you select a "next day delivery" option, orders placed on Fridays, Saturdays or Sundays may not be dispatched for delivery until the following Monday and so may not be received until Tuesday.
    • Order Cancellation
      • If you wish to cancel an order you have placed, you must contact us immediately to ascertain whether the items have been dispatched or not. Where they have been dispatched, you will need to return the item to us and you will be responsible for paying the cost of returning the items.
      • Where items have not been dispatched prior to a cancellation request, our refund policy will apply.
      • Where you have ordered a personalised, perishable or time critical item (such as food, newspapers, event tickets or e-vouchers) you may not be able to cancel for a full refund.
    • Returns
      • You need to contact us within 15 days after receiving your item to request a return. To be eligible for a return, your item must be in the same condition that you received it, unworn or unused, with tags, and in its original packaging. You’ll also need the receipt or proof of purchase. If your return is accepted, you can return the goods to us for inspection
      • Items sent back to us without first requesting a return will not be accepted.
    • Damages and issues
      • Please inspect your order upon reception and contact us immediately if the item is defective, damaged or if you receive the wrong item, so that we can evaluate the issue and make it right.
    • Exceptions / non-returnable items
      • Certain types of items cannot be returned, like perishable goods (such as food, flowers, or plants), custom products (such as special orders or personalized items), and personal care goods (such as beauty products). We also do not accept returns for hazardous materials, flammable liquids, or gases. Please get in touch if you have questions or concerns about your specific item.
      • Unfortunately, we cannot accept returns on sale items or gift cards.
    • Exchanges
      • The fastest way to ensure you get what you want is to return the item you have, and once the return is accepted, make a separate purchase for the new item.
    • Refunds
      • We will notify you once we’ve received and inspected your return, and let you know if the refund was approved or not. If approved, you’ll be automatically refunded on your original payment method. Please remember it can take some time for your bank or credit card company to process and post the refund too.
    • Liability And Indemnity
      • We shall not be liable for any direct, special, indirect, or consequential or incidental damages including loss of profit or loss of opportunity as a result of the use of or the inability to use any items that have been ordered on this website.
      • You agree to indemnify us and our agents, officers, directors, and employees, immediately and on demand, against all claims, liability, damages, costs and expenses, including legal fees, arising out of any breach of any of our terms and conditions.
    • Jurisdiction
      • These terms and conditions shall be governed in accordance with Kenyan Law and are subject to the exclusive jurisdiction of the courts of Kenya.
  • PRE-ORDER UK 2 KENYA TERMS
    • Payment in Kenya can be made in either Kenya Shillings (KES) or Great Britain Pound (GBP). Payment details will be provided with invoice
    • Retail (Personal) Payments terms: Cost of goods should be paid for 100% with Order Confirmation. Invoice for the shipping costs will be issued at the point of dispatch and payment is due on delivery or during collection. Terms and Conditions apply.
    • Business Orders (Wholesale) Payments terms: Please refer to the agreed terms and conditions agreed under your Trade account.
    • Shipping & Delivery
      • Processing time: While we do our best to make sure that most of the products on our UK website are in stock and ready to be dispatched by Air or Sea Cargo shipping, please note that personalised orders will need to be sourced from various manufacturers and other retailers including from third party high street retailers and ecommerce stores, we advise that you allow enough processing time so that the goods can reach our UK depot where they will be prepared for shipping.
      • AIR CARGO: After the goods have been received in our warehouse, consolidated, and dispatched, please allow 7-14 days delivery time
      • SEA CARGO: After the goods have been received in our warehouse, consolidated, and dispatched, please allow 6-8 weeks delivery time.
    • Restrictions & Limitations
      • AIR CARGO Restricted goods includes but not limited to products that contain lithium batteries e.g., laptops, phones, anything that contains liquid or compressed air e.g., perfume spray, nail polish etc. Since our service is personalised to you, we provide a step-by-step guide and costing to ensure your shipment meets all the requirements.
      • SEA CARGO Restrictions: heavy machinery like car engines, lawnmowers etc that contain liquids for example petrol, and oil will need to be drained before they can be shipped. Since our service is personalised to you, we provide a step-by-step guide and costing to ensure your shipment meets all the requirements.
      • IMPORTANT: Whilst we do our best to ensure that your products reach your hands as smooth as possible, there are some delays that are beyond our control which might include, manufacturing delays, customs procedures, seizure, or removal. In the event of such occurrence, we shall make sure that you are kept updated and shall work with you and the relevant authorities to resolve the matter as quickly as possible.
      • This is a “Buy for you” service with exemption to members of our Executive Club
    • Jurisdiction
      • These terms and conditions shall be governed in accordance with English Law and are subject to the exclusive jurisdiction of the courts of England & Wales.

    5. ENTIRE AGREEMENT

    • These terms and conditions combined with our published Privacy Policy (also available through this website) and Refund Policy (also available through this website) constitute the entire agreement between the parties and supersede any and all preceding and contemporaneous agreements between you and us whether written or oral.
    • Should any part-term or term be found to be unenforceable then the remainder of the terms and conditions shall continue to have full force and effect as if the invalidated term was not present.
    • Should any delay or failure to comply with our obligations under these terms and conditions arise where it is beyond our reasonable control, we will not be responsible to you for such delay or failure nor liable for any loss that you incur, howsoever caused.
